Many people do not realize that they may qualify for Social Security Disability benefits. There are some rules that apply, but if you fit the basic requirements, you may be eligible to receive financial assistance. To learn more about Social Security benefits and to see if you qualify, consult with an experienced Social Security attorney.

How do You Qualify?

You need to be disabled as it is categorized under the Social Security Administration’s guidelines. Their definition of disabled is very strict and they will only pay for complete disability. If you are considered to only have short-term or partial disability, you will not qualify for assistance.

In order for the Social Security Administration to deem you as disabled, they will assess your ability to work. If you are unable to do the work that you were doing prior to becoming disabled and are unable to transition to another form of work, you will have passed the first requirement. The second requirement is that your disability must be proven to last for more than one year or result in death.

The Administration has set up five steps that will help an individual determine if they are considered disabled and therefore qualify for assistance.

  • First, they consider your earnings. If you continued to work once you were disabled, there is a cap as to what you could have earned per month during the first year that you were disabled.
  • Second, your medical condition must be severe enough to prevent you from working on a consistent basis.
  • Third, your medical condition must be on the Social Security Administration’s qualifying list.
  • Fourth, your disability has to prevent you from doing the same type of work that you were doing prior to your disability.
  • Fifth, you cannot find another job that is better suited to your disability.

If you find that you meet requirements 1-3, then you are technically considered disabled by the Administration.
